TICKET HOLDER TERMS

***The terms and conditions of Return to Rio are set out below. They contain important information about the event. They also set out the express basis of your entry to the event, which includes an indemnity and release in favour of the organisers. You should read these terms and conditions carefully.**

TERMS & CONDITIONS

These terms & conditions shall constitute a contract between Techwood Products Pty Ltd  (ABN   64100340752) (“Promoter”) and you (“you”) in relation to the event known as “Return to Rio” (“Event”) to be held at Del Rio Riverside Resort, Wiseman’s Ferry (“Site”). Any ticket purchased in respect of the Festival and your entry to and presence at the Event is subject to the following terms and conditions.

GST POLICY

All service and delivery fees are inclusive of Goods and Services Tax (GST).

REFUND AND CANCELLATION POLICY

If the event is cancelled in whole or in part for any other reason, including by Act Of God or act of war or industrial dispute or by any event outside the control of the Promoter then refunds shall be at the Promoter’s absolute discretion. If a refund is available, the Promoter will determine the amount of the refund which will be subject to deductions for handling fees and costs incurred. Refunds or part refunds (if available) will only be paid pursuant to a written request by, or on behalf of the Ticket Holder and if that request is accompanied by the original ticket and proof of purchase, and is presented within 60 days of the Ticket Holder being notified of the cancellation.

The Promoter will not be held liable for any loss, damage or compensation as a result of the Event being cancelled, postponed, relocated or changed for any reason.

If an event is cancelled due to COVID-19, the event will be rescheduled.

If for any reason you can’t attend the new date, refunds will not be issued, you will be issued a credit to use for the festival the following year.

ARTIST & RUNNING ORDER CHANGES

In relation to the Event, the Promoter reserves the right to add, withdraw or substitute artists, vary the advertised program and audience capacity and deny admission with reasonable cause. The Promoter is not liable for any damage, compensation, loss or expenses as a result of these changes.

WEATHER POLICY

The Event is an all-weather event and will continue rain, hail or shine. Please dress appropriately and bring summer clothes, sunscreen, warm clothes and wet weather gear.

AGE RESTRICTIONS

The Event is an over 18’s event only and valid photo ID must be shown to gain entry.

CONDUCT AT THE EVENT

The Promoter reserves the right to refuse you entry to and/or eject you from the Event and/or Site in reasonable circumstances including without limitation:

  1. For health and safety or licensing reasons;
  2. If you behave in a manger which has or is likely to affect the enjoyment of other persons at the Event;
  3. If you use threatening, abusive or insulting words or mannerisms;
  4. If in the Promoter’s reasonable opinion you are acting under the influence of alcohol or drugs;
  5. If you fail, when required, to produce proof of identify or age;
  6. If you breach these terms and conditions;
  7. If your ticket to the Event is void.

PROHIBITED ITEMS

You must NOT bring any of the following items onto the Site:

  1. Glass – Patrons will not be allowed to bring in glass bottles of any kind onto the Site. Broken glass is dangerous for kids and for animals that will be using the Site after the event;
  2. Sound systems – Sound systems are NOT allowed or welcome on the Site or in the campsite. We have to respect our neighbours;
  3. Animals – Animals are NOT allowed under any circumstances in the Site or in the campsite area;
  4. Any illegal drugs – full searches will be conducted prior to entry;
  5. Weapons or knives (including pocket knives); and
  6. Fireworks or anything dangerous.

You may be inspected for prohibited items on entry or during the Event. If you are found with prohibited items you may be refused entry, ejected or have those items confiscated. Confiscated items will not be returned or replaced.

The Promoter reserves the right to conduct security searches from time to time, and to refuse admission to you, or eject you, from the Event and/or Site should you refuse to comply with such security searches.

DELIVERY METHODS

Registered Post: If you have opted for your order to be sent via Australia Post, your order will require a signature for delivery. No refunds or exchanges will be issued for lost packages as this is a secure delivery. A unique identification number for every article is recorded, and insurance cover of up to $100 is included. Good for delivery anywhere in Australia!

Own Risk: Entry to the Event site is at the Ticket Holder’s own risk and Ticket Holders must take reasonable care to protect themselves from harm during the Event and while on the Event site. Without limiting the generality of this condition. Ticket Holders: must wear appropriate footwear and clothing at all times; must not ‘mosh’, crowd surf or stage dive; must not stray into cordoned off areas or unmarked areas; must not climb trees; must wear ear plugs if necessary.

No Liability: The Promoter and/or Event site owner will not be liable or responsible for any injury, loss or damage suffered or incurred by the Ticket Holder whether caused by the negligence of the Promoter or that of the owner of the Event site (or any of their respective employees, contractors, or agents) or otherwise. Any such injury, loss or damage to a person or property is at the Ticket Holder’s own risk (including any hearing loss or damage caused by excessive noise). In the event of injury or illness, the Promoter is authorised, at the Ticket Holder’s own expense, to arrange medical treatment and/or emergency evacuation as required in the Promoter’s discretion. The Promoter will not be held liable for any injury, loss or damage occurring at the Festival site, so Ticket Holders are also reminded that all valuables and personal property should be kept safe and secured.

Release: To the fullest extent permitted by law, Ticket Holders waive all legal rights of action against and fully release the Promoter and owner of the Event site (and their respective executive members, directors, officers, employees, volunteers, contractors or agents) from any liability for any personal injury, loss, damage, death economic loss or consequential loss for any default, failure or negligence (to the extent permitted by law) howsoever arising out of or in relation to the Ticket Holder’s entry to and presence at the Event site.

ENGAGING THE SERVICES OF RETURN TO RIO

If payment is not made on the Due Date, the Supplier will be entitled, without limiting any other rights it may have, to charge interest on the outstanding amount (both before and after any judgment) at the Total rate of interest published on the Office of State Revenue’s website (http://www.osr.nsw.gov.au/info/compliance/penalty) for the relevant period from the Due Date accrued daily until the outstanding amount is paid in full.

After 30 days of non-payment from the Due Date all work will cease, and after 60 days of non-payment, the invoice will be forwarded to a collections agency to process the debt (“Debt Collector”).

In the event a Debt Collector is engaged by the Supplier to process the debt, in addition to the charges incurred by the Client under this clause 3, the Client shall be charged any Debt Collector fees incurred by the Company.
